The Law Firm has been operating since 2004. We provide legal services both to entrepreneurs and private clients. We assist and support our Clients in accomplishing their objectives. The Law Firm has experience in the scope of corporate advisory and is a regular advisor, as part of ongoing legal services, of many companies. We provide ongoing legal consultations, including advisory in the scope of the conducted economic activity, agreements and contracts, participation in negotiations, and we represent Clients in court and administrative proceedings. Legal services also include the issues in the scope of the Penal Law, connected with the activity conducted by our Clients.

 

Since the establishment of the Law Firm we have advised both international corporations and Polish entrepreneurs in the scope of many business undertakings, taking part in preparation of comprehensive legal analyses of economic entities and in advisory at the time of concluding transactions. We also represent natural persons in court proceedings.

 

 

On 11 February 2015 the Supreme Court approved the cessation appeal filed by the Law Firm (case reference number I CSK 753/13) and quashed the ruling of the Court of Appeal in Warsaw. The Supreme Court was on the position that the plea of violation of the following articles of the substantive law: Articles 1027 of the Civil Code, 123 1 item 1 of the Civil Code, 1007 Section 2 of the Civil Code in the wording applicable prior to 12 October 2011, raised in the cessation appeal, was justified.

 

The Supreme Court stated that the position contained in the resolution dated 10/10/2013, III CZP 53/13, according to which the submission by the party entitled to legitim of a petition for ascertainment of acquisition of the estate of the deceased person stops the running of the lapse period for the claim for legitim due from the inheritor; it directly refers to the claim for legitim of the heir at law entitled to inherit under the act against the heir at law, which corresponded to the situation of the Client we represented.

 

That is why our Client's claim for legitim was finally awarded in compliance with the brought action. The Supreme Court dismissed the appeal and upheld the ruling of the Regional Court for Warszawa-Praga, which was favourable to the Law Firm's Client, in test case related to admissible causes of stopping the running of the lapse period for legitim. The final ruling, which was favourable to our Client, allowed her to obtain the legitim due to her after her grandmother, who had donated, during her lifetime, the only component of the estate, being a flat located in Warsaw, to the second heir at law.
